These Terms of Service ("Terms") govern your use of theotterlab.com (the "Site"), operated by The Otter Lab LLC ("The Otter Lab", "we", "us"), a company based in North Carolina. By using the Site, you agree to these Terms. If you do not agree to these Terms, do not use the Site.

These Terms cover this Site only. Our games and apps have their own terms, available on each product's website and in the store where you get them.

Using the Site

You may use the Site to learn about us and our work, contact us, and join our waitlist. When using it, you agree not to:

  • break any law or anyone else's rights;
  • send spam, malicious code, or false or misleading information through our forms;
  • try to disrupt the Site, overload it, or access parts of it or its systems that are not meant for you;
  • copy or scrape the Site's content in bulk, including with automated tools.

Our content

The Site and its content, including text, artwork, characters, animations, logos, and the names of The Otter Lab and our games and apps, belong to The Otter Lab LLC or our licensors and are protected by copyright and trademark law. You may view the Site and share links to it. You may not otherwise copy, modify, or reuse our content without our written permission.

Ideas and materials you send us

Please do not send us any information or materials you consider confidential or proprietary through the Work with us form or by email. Unless we have entered into a separate written agreement with you:

  • anything you send us is not treated as confidential;
  • sending us an idea does not create any business relationship or obligation to you; and
  • we may already be working on, or later develop, games or apps similar to ideas we receive, and we have no obligation to compensate you for them.

If we take on a project with you, the terms of that work will be set out in a separate written agreement.

Waitlist and emails

If you join our waitlist, you agree that we may email you about our games, apps, and launches. You can unsubscribe at any time using the link in our emails or by contacting us. Joining the waitlist does not guarantee access to any product, and release dates and features we mention may change.

Other websites

The Site links to websites we do not operate, such as social media platforms, app stores, and our product websites. We are not responsible for their content, policies, or practices.

Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Site will always be available or error-free, and information on it may change without notice.

Limitation of liability

To the fullest extent permitted by law, The Otter Lab LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Site. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations, so they may not all apply to you.

Indemnity

If you misuse the Site or break these Terms, you agree to cover any claims, losses, and reasonable legal costs we incur as a result.

Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in North Carolina, and you agree to the jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version here with a new effective date. Continuing to use the Site after a change means you accept the updated Terms.

General

If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of our right to do so later. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site.
